We all know that tenants of a home have many rights, but also obligations. However, there are also rights and obligations for the owner of said home. Like tenants, landlords have a series of privileges that they can enjoy and that it is advisable to know in detail. All of these are defined in the Urban Leasing Law . In this article, we have decided to explain in detail everything that revolves around the rights and obligations of the owners of rental properties; keep reading.


Where are the obligations of an owner defined?
When renting a home, the owner's obligations are established in two different places:


Part of it is found in the legislation applicable to Email Data leases. In this case, we refer to theUrban lease law(Law 29/1994, of November 24). However, we can refer to others that specify some obligations of the owner in question. For example, tax laws, energy efficiency legislation, among others.
The other part can be found within the lease contract. This document may determine additional obligations for the landlord or tenant. In addition to this, you can collect the issues established by law. For example, an agreement can be reached and the owner must be responsible for specific expenses; some that do not legally correspond to him.
In short, there are two types of obligations that the owner must comply with when renting a home: those of legal origin and those of contractual origin . These condition it and, in both cases, the tenant has the right to demand compliance.






Main obligations of an owner
If we stop to observe what is described in the urban leasing legislation and other applicable regulations, we will know what the main obligations of the owner of a rental home are:


Make the home available to the tenant in an excellent state of conservation.
Deliver the apartment on the date established in the lease contract . Of course, the owner must take into account that he will no longer have free access to the apartment. He may only do so with the consent of the tenant or through judicial authorization.
Pay all fees applicable to home ownership and due taxes. Among these rates, for example, we can find municipal taxes such as the IBI, the garbage rate, among others.
Maintain the home under habitable conditions . In theory, the owner must carry out all therepairs and maintenancethat the property may need. All, without the right to increase the established rental price. The only exception may arise when the damage is due to the tenant's own cause. This being the case, it is the tenant who must bear the costs of maintenance or repair.
